WAIVER AGREEMENTPlease check that you agree for each paragraph

1. I intend to enter the premises of the Alliance, a non-profit corporation located at 1345 Bush Street San Francisco CA 94109 (“the Premises”) to engage in certain activities, such as classes, seminars, discussions, film viewing, meetings, and/or social gatherings “Activities”). 2. In exchange for permission by the Alliance to be on the Premises and engage in any such activity, I agree to all the terms and conditions set forth in this Agreement. 3. I am aware that diseases such as COVID-19 ("Disease”) are highly contagious and I may be exposed to or contract the Disease or other infectious diseases by being on the Premises and engaging in Activities. 4. I understand and acknowledge that such exposure or infection may result in serious illness, personal injury, permanent disability, death, or property damage. I acknowledge that this risk may result from or be compounded by the actions, omissions, or negligence of others, including staff and volunteers working with the Alliance. I understand that while the Alliance has implemented measures designed to reduce the spread of the Disease, it cannot guarantee that I will not become infected with the Disease or other infectious diseases while on the Premises. I further understand that being on the Premises may increase my risk of contracting the disease. 5. Notwithstanding the risks associated with the Disease, I acknowledge that I am voluntarily entering the premises to engage in one or more of the activities with knowledge of the danger involved. I hereby agree to accept and assume all risks of personal injury, illness, disability, death, or property damage related to the Disease, arising from my being on the premises or engaging in the Activities, whether caused by the ordinary negligence of the Alliance or otherwise. 6. I hereby expressly waive and release any and all claims, now known or hereafter known, against the Alliance, and against its officers, directors, manager[s], employees, agents, affiliates, members, successors, and assigns (collectively, "Releasees”), on account of injury, illness, disability, death, or property damage arising out of or attributable to my being on the Premises or engaging in one or more of the Activities and being exposed to or contracting the Disease, whether arising out of the ordinary negligence of the Alliance or any Releasees or otherwise. 7. I promise not to make or bring any such claim against the Alliance or any other Releasee, and forever release and discharge the Alliance and all other Releasees from liability under such claims. This waiver and release does not extend to claims for gross negligence, intentional misconduct, or any other liabilities that state law does not permit to be released by agreement. 8. I understand that by signing this Agreement, I am waiving any and all claims of any kind arising out of or attributable to my being on the Premises or engaging in the Activities and being exposed to or contracting the Disease, including those claims that may be unknown to me, or which I do not suspect to exist at this time. 9. I understand that most states, and possibly my own, have adopted a state law stating that a general release of claims (such as this one) does not extend to claims which the releasor (me) does not know about at the time of executing the release and that such claims, if the releasor were to learn of them, might affect his or her desire to enter into the release. 10. I hereby expressly waive the protections of such state laws as I intend to release Alliance from all COVID-19 and other disease-based claims, including the ones I do not know about or know to exist. 11. I understand that I am responsible for taking precautions while on the Premises to avoid infection. This means that I will comply with all safety measures and instructions on masking and social distancing. I will not participate in any activity on the premises if I am sick or have COVID-19 symptoms. 12. I will not enter the Premises if I have a confirmed or suspected case of the Disease, or have come in contact in the last 14 days with a person who has been confirmed to have or who is suspected of having the Disease. 13. This Agreement constitutes the sole and entire agreement of the Alliance and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. 14. This Agreement is binding on and shall inure to the benefit of the Alliance and me and our respective successors and assigns.

BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE ALLIANCE.
